Event Waiver

I, as the “Participant,” am familiar with the nature of the activities that will take place in the Boppn Event and I desire to participate in this event. I hereby acknowledge that my participation in this event is voluntary. I hereby certify that I am 18 years of age or older, which is the legal age of majority in my jurisdiction, allowing me to enter into this agreement and participate in the Boppn Event without the need for parental or guardian consent.

I am not aware of any injury, illness, or other health related issue that would restrict or limit my ability to participate in Boppn's Event. I acknowledge that I am physically fit to participate in the Boppn Event.

ASSUMPTION OF RISK / WAIVER / RELEASE / INDEMNIFICATION

I understand and fully and completely accept that there are inherent risks involved in participating in the Boppn Event, and that accidents, injuries, and damage to myself, other persons, and/or property may occur during the event. Accordingly, I hereby knowingly and freely accept and assume any and all such risks, both known and unknown.

In consideration of my being permitted to participate in the Boppn Event (and related events and activities), I hereby covenant not to sue and to forever release Boppn LLC and/or any of its owners, members, officers, employees, agents, volunteers, other participants, sponsors and advertisers (collectively, the “Released Parties”), from any and all present and future claims, damages, injury, disability, death and loss or damage to person or property (whether resulting from negligence or any other cause), resulting from my participation in the Boppn Event and/or any other activities related thereto, when or however the same may occur. To the fullest extent permitted by law, I hereby waive any and all claims resulting from any cause (including negligence) that may (or may otherwise have been) made by me, my family, estate, heirs and assigns.

I further agree to indemnify, defend, and hold Boppn LLC and the Released Parties harmless from and against any and all claims, losses, liabilities damages, costs, and expenses arising from or in any way incurred or connected with any injury and/or property damage that I may cause or sustain while participating in the Boppn Event. I understand and agree that neither Boppn LLC nor the Released Parties are responsible for any harm in any way whatsoever that I may incur or cause in connection with my participation in the Boppn Event. I attest that any consumption of alcohol is my own choice, and neither Boppn LLC nor the Released Parties are responsible for any harm that I may cause or incur as a result of consuming alcohol throughout the Boppn Event.

I understand and agree that the Boppn Event may include optional challenges involving the consumption of alcohol. While none of these activities are mandatory, if my team chooses to take on any of these activities, I will follow all applicable state laws, including but not limited to underage drinking laws and laws prohibiting serving alcohol to minors. I further understand and agree that any consumption or use of alcohol is wholly my own personal responsibility. I understand and agree that neither Boppn LLC nor the Released Parties will assume any responsibility whatsoever should I choose to consume alcohol, and I understand that alcohol is a drug which can cause serious health consequences and unacceptable behavioral manifestations.

I am aware all activities that are a part of the Boppn Event are completely voluntary and there is no specific task or challenge that must be completed in order to win. In the event I am unable to participate, I understand there are no refunds for any payments made.

MEDIA RELEASE / CONSENT

In consideration of my being allowed to participate in the Boppn Event (and for other valuable consideration which I acknowledge receiving), I grant permission to Boppn LLC to take audio, video, photographic and other recordings of me and to use such recordings and my name, likeness and voice/sound in perpetuity anywhere in the world and in all types of media (including any new forms developed after the date hereof). I understand that I will not receive any compensation for the use of the audio, video, photographic and other recordings of me from Boppn LLC. I release Boppn LLC and the Released Parties from all claims by me or any person acting on my behalf in connection with this consent. I agree that the consent and release given by me in this form cannot subsequently be revoked by me.

I agree that Boppn LLC may edit, clip, caption, and combine these recordings and the photos and videos I submit, and may use them in recap videos and in Boppn's website, social media, advertising, and other marketing.

For Private Events, Boppn will only use photos and videos I submit in marketing if the event organizer approves, and its use of them is limited as described in the Privacy Policy.

RECAP VIDEOS AND AI TOOLS

Boppn may use photos and videos from the event to make recap videos. Recap videos may be shown to my team and other participants in the app, and may be given to the event organizer.

I understand that Boppn staff and artificial-intelligence tools help review, transcribe, describe, caption, and edit this media, and that these tools may send copies of it to providers such as Kino and Anthropic (Claude). Boppn uses these tools only to organize and edit recap videos for the event and does not sell this media.

THIRD PARTIES AT THE EVENT

I (participant) am not required to interact with third parties (individuals not involved in the event). If third parties choose to interact with me, I acknowledge I have received verbal permission from all such third parties to be included in event videos/pictures. I acknowledge that the third party understands their image may be posted on Boppn social media/website for promotional purposes.

COMMUNICATION ACKNOWLEDGEMENT

I agree to receive communications from Boppn LLC related to my participation in the Boppn Event, including, without limitation the following:

Message and data rates may apply. Message frequency may vary. I understand that I can opt out at any time by replying STOP to text messages or unsubscribing from emails.

TEAM COMMUNICATION AND CONTACT INFORMATION SHARING

As part of the event experience, the Boppn app includes a group chat feature designed to facilitate communication among team members. By registering for and participating in the event, you acknowledge and agree that your name, phone number, and email address will be shared with the other members of your assigned team, who may or may not be known to you prior to participation. This information is shared solely for the purpose of enabling collaboration and communication within your team during the event. By signing up, you expressly consent to this sharing of your contact information with your teammates. If you do not wish to share this information with other participants, please do not register for or use the app.

THIRD PARTY DISCLOSURE

Use of Twilio

At Boppn, we use third-party services to enhance your experience and ensure secure participation in our events. Specifically, our login provider, Supabase, uses Twilio, a trusted communications platform, to deliver one-time passcodes for account verification and secure access to features.

Data sharing with Twilio

We only share the minimum data necessary with Twilio to enable this service, such as phone numbers and message content relevant to authentication. We do not share location data, answers, photos, or videos with Twilio. We do not sell your phone number, or share it with third parties for their own marketing.

Event and marketing text messages

We use a text-messaging provider to send event reminders, updates, and marketing messages when permitted. We share your phone number and the content of these messages with that provider so it can deliver them.

Reply STOP to opt out of text messages or HELP for help. If you opt out, we may still send one-time passcodes you request.

Data protection and security

All data shared with Twilio is transmitted securely and handled in accordance with their privacy and security policies. Twilio is certified under internationally recognized standards such as ISO/IEC 27001 and complies with applicable data protection laws.

AGE CONFIRMATION AND PARTICIPANT DOCUMENT REVIEW

I am over 18 years old (the legal age of consent), or over 21 if the event requires it, and in my right mind and not under the influence of any substance or force. By my approval, I agree that I have read this document carefully before approving, that I fully understand the meaning and impact of this document (including, without limitation, the assumption of risks, waiver, release, indemnity and consents) and that I agree to all of the terms and provisions set forth herein.
